What obligations does my employer have in terms of good faith?

The overarching obligation imposed by the Employment Relations Act on employment relationships is the duty to act in good faith. Any dealings with employers in relation to the consequences of the earthquake must comply with the good faith provisions of the Act. The section in the Act that is likely to have the most significant implication is Section 4(1A) which provides that the employer is required to provide affected employees with access to information in relation to a decision that may adversely effect the continuation of employment. As noted above, the extent to which an employer is required to consult will depend on the circumstances.
