If your employer insists on a trial period clause in your written employment agreement you have the right to suggest alternative versions. Here are a couple of suggestions which you could offer instead:

“Before notice of dismissal is given during the trial period the employer will tell the employee of any performance or misconduct issues and give the employee a reasonable opportunity to correct any problems”


“The employer and employee will at all times act reasonably and in good faith and, in relation to dismissal, in accordance with the principles of natural justice.”
